Terms of Service

These Terms govern your use of salonwins.com and any service we offer from it (the “Service”). The Service is provided by [Arcate Labs LLC, State of Operation] (“we”, “us”). By using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Disclaimer.

What the Service does

SalonWins runs a free Salon Report Card for salons. The scan queries multiple AI providers (Claude, ChatGPT, Gemini, Perplexity), pulls Google rankings and reviews, audits your website, and benchmarks the top three local competitors, then hands back a graded report with a priced, line-itemized action plan. We also sell the done-for-you services priced inside that plan (on-page, off-page, technical, Google Business, reviews, AI visibility, conversion), a one-time DIY Growth Playbook, and custom-quoted engagements.

Accounts and access

We use email magic links (no passwords). You’re responsible for the email account you use and for keeping your magic-link emails private. Don’t share your report link with anyone you wouldn’t share the underlying data with.

Paid services

When paid services are active, payments are processed by Stripe. The DIY Growth Playbook is a one-time charge ($97 at launch). Done-for-you services are quoted from the report's line items at a flat, fixed-scope price — there is no monthly retainer. Refunds are governed by our Refund Policy. You authorize us (and our payment processor) to charge the payment method you provide for the amount disclosed at checkout, plus any applicable tax.

Acceptable use

You agree to use the Service in accordance with our Acceptable Use Policy. In short: no scraping, no scanning other people’s salons without permission, no using SalonWins to manipulate AI search results or harass others, no reverse-engineering, no illegal use.

Your content; our content

You retain ownership of information you submit about your business. You grant us a worldwide, non-exclusive license to process that information as needed to run the Service, improve it, and provide your report.

SalonWins reports, scoring logic, prompts, UI, and copy are our intellectual property. You may use your report for your own business; you may not resell or republish it without our permission.

AI output disclaimer

Scan output is AI-generated and reflects the state of third-party AI models at a point in time. It can be wrong, incomplete, or inconsistent between runs. See our full Disclaimer. You are responsible for any actions you take based on a report.

Warranty disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific result will be achieved.

Limitation of liability

To the maximum extent permitted by law, SalonWins and Arcate Labs LLC are not liable for indirect, incidental, consequential, special, or punitive damages. Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100 USD.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of (a) your use of the Service, (b) your violation of these Terms or our policies, or (c) your violation of any third-party right.

Termination

We may suspend or terminate your access at any time for violations of these Terms or our Acceptable Use Policy. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the state in which Arcate Labs LLC is organized, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in that state, unless we mutually agree otherwise.

Changes

We may update these Terms as the product evolves. Continued use of the Service after an update means you accept the updated Terms.
